While more than 1.2 million Bosnians still have not returned after fleeing the conflict, the vast majority successfully received refugee status in countries of asylum. The most positive conclusion from the Bosnian experience remains the management of the humanitarian effort during the war and the reception given to more than two million people who desperately needed protection. From the vantage point of host states, this demonstrates that temporary and large-scale humanitarian protection is possible. The history of humanitarian protection in Bosnia and Herzegovina is especially relevant to the contemporary horrors of the conflict in Syria that has destroyed much of the country and caused the displacement of more than eight million people. While the European Union Member States remain in disagreement over the relocation of some 60,000 Syrian refugees, the Bosnian experience demonstrates that people can be effectively protected, resettled and integrated in Europe. Cooperation is possible. That must be one of the key messages from this tragedy. Adapted from the source document.

Democratic Development, Judicial Reform and the Serbian Question in Croatia

In anticipation of Croatia's accession to the European Union, this article assesses the way in which the state has come to terms with the Serbian question and the practice of non-discrimination in the justice sector. The first part offers an historical review of the Serbian question in Croatia and the main laws that discriminated against non-Croats during the war and rule of President Franjo Tudjman (1991-1999). The second part evaluates the nature of judicial reform in light of the external demands placed on Croatia to improve relations with the Serbian minority and recent rulings from the European Court of Human Rights, which have questioned the capacity of the Croatian judiciary to provide an effective remedy in cases of human rights violations. Croatia has entered a critical period in its membership negotiations with the European Union. Enmeshed in a screening process where its laws are subject to close scrutiny by the European Council, Croatia must demonstrate that they conform with the political criteria. While it has international backing, there are still several important obstacles to overcome. These include reassuring an increasingly sceptical public at home & tackling internal problems regarding the pace of refugee returns & reform of public institutions, above all the judiciary.
